In using this website you are deemed to have read and agreed to the following terms and conditions: The following terminology applies to these Terms and Conditions, Data Security and Disclaimer Notice and any or all Agreements: “Client“, “You” and “Your” refers to you, the person accessing this website and accepting the Company’s terms and conditions. “Top Chef Cooking Studio”, “The Company“, “Ourselves”, “We” and “Us“, refers to our Company. “Party”, “Parties”, or “Us”, refers to both the Client and ourselves, or either the Client or ourselves. Any use of the above terminology or other words in the singular, plural, capitalization and/or he/she or they, are taken as interchangeable and therefore as referring to same.

General

The law of the United Arab Emirates, as applicable in Dubai, governs these terms and conditions. By accessing this website and using our services/buying our products you consent to these terms and conditions. Your terms and conditions shall not apply, unless accepted by us in writing. If any of these terms are deemed invalid or unenforceable for any reason then the invalid or unenforceable provision will be severed from these terms and the remaining terms will continue to apply. Failure of the Company to enforce any of the provisions set out in these Terms and Conditions and any Agreement, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these Terms and Conditions or of any Agreement or any part thereof, or the right thereafter to enforce each and every provision. These Terms and Conditions shall not be amended, modified, varied or supplemented except in writing and signed by duly authorized representatives of the Company.

Data Security

Top Chef Cooking Studio will use its best efforts to protect your privacy. Authorized employees within the company on a need to know basis only use any information collected from individual customers. We will not sell, share, or rent your personal information to any third party or use your e-mail address for unsolicited mail. Any emails sent by the Company will only be in connection with the provision of agreed services and products. We will use our best efforts to provide the highest level of support in order to maintain maximum information security. However as you are aware – we cannot guarantee absolute security for the website and therefore cannot be held liable against it in any manner whatsoever.

Online Accounts

If you create an account on the Website, please follow the instructions on our webpage to do so. You need to be at least 18 years of age to order with us. You are solely responsible for maintaining the security of your account, and

you are fully responsible for all activities that occur under the account and any other actions taken in connection with the account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions.

Payment

We accept payments via Credit Card (Mastercard & VISA). Prices quoted are in UAE Dirhams and all payments are to be made in UAE Dirhams.
All prices quoted are based on advance payments unless otherwise agreed in writing.
Our prices are subject to change at any time without prior notice.
We will bill your credit card as soon as you place a booking with us. Once the amount is confirmed by your bank we will process your booking and send a confirmation by email. If on occasion a service may be unavailable after processing your order and billing your credit card we will provide you with an option (i) to consider selecting an alternative product or (ii) opting for a refund should we be unable to determine when the product you want may be back in stock. It may take up to 15 days for a refund to be credited back to your card. We cannot process your bookings in case your credit card company does not authorize the payment prior to the requested delivery date. Should we incur any additional costs due to a delay in payments or short payments that are not in line with your order you agree to compensate these costs for us in due course.
Should a payment not be processed by your bank you need to contact us directly via phone or email to correct your booking as soon as possible during our business hours.

Studio Policy

Scheduled Classes

  • Booking must be made at least 2 working days hours in advance.
  • Rescheduling is permitted free of charge only if done at least 2 working days prior to the class.
  • Cancellation up to 2 working days before the class will imply a 10% penalty on a refund, plus a 2.5% credit card charge if applicable.
  • No cancellation or rescheduling accepted less than 2 (two) working days prior to the class. Full charges will apply without the possibility of rescheduling.
  • Classes start at the scheduled time. We advise you to arrive 15 minutes prior. Late arrivals may not be accepted in the class. No refund or rescheduling will be provided.

Force Majeure

Neither party shall be liable to the other for any failure to perform any obligation under any Agreement which is due to an event beyond the control of such party including but not limited to any Act of God, terrorism, war, Political insurgence, insurrection, riot, civil unrest, act of civil or military authority, uprising, earthquake, flood or any other natural or manmade eventuality outside of our control, which causes the termination of an agreement or contract entered into, nor which could have been reasonably foreseen. Any Party affected by such event shall forthwith inform the other Party of the same and shall use all reasonable endeavors to comply with the terms and conditions of any Agreement contained herein.

Changes

Top Chef Cooking Studio reserves the right, at its sole discretion, to modify or replace any part of this Agreement. It is your responsibility to check this Agreement periodically for changes. Your continued use of or access to the Website following the posting of any changes to this Agreement constitutes acceptance of those changes. Essentially may also, in the future, offer new services and/or products through the website. Such new products and/or services shall be subject to the terms and conditions of this Agreement, as may be amended from time to time.

Limitation of Liability

In no event will Top Chef Cooking Studio, or its suppliers or affiliates, be liable with respect to any subject matter of this agreement under any contract, negligence, strict liability or other legal or equitable theory for: (i) any special, incidental or consequential damages; (ii) the cost of procurement or substitute products or services; (iii) for interruption of use or loss or corruption of data; or (iv) for any amounts that exceed the fees paid by you to Top Chef Cooking Studio under this agreement during the twelve (12) month period prior to the cause of action. The company shall have no liability for any failure or delay due to matters beyond their reasonable control.

Indemnification

You agree to indemnify and hold harmless Top Chef Cooking Studio, its suppliers and affiliates, and their respective directors, officers, employees and agents from and against any and all claims and expenses, including attorneys’ fees, arising out of your use of the Website, including but not limited to your violation of this Agreement.
